What is mumspace.net?

Mumspace.net is designed specifically for mums and mums-to-be and offers users the opportunity to set up their own space on the web where they can post blogs and diaries, photos and favourite web links, as well as other functionality as it becomes available, either for public or private viewing. Through their mumspace, users have the opportunity to develop and communicate with a network of other mums - whether that be other mumspace members or members of the public.

What do the terms of use mean?

The terms of use are the conditions that surround your use of the site. By signing up for a mumspace or by being a guest on our site, you are agreeing to these terms, forming a contract between you and mumspace.net.

If the following terms are not agreeable to you, you should exit the site immediately and cease using any services that you have signed up for. Please note that our services are designed for use by those 18 and over. If you are not 18 or over, you should cease using the mumspace.net services.

Changes to terms

Mumspace.net is a constantly evolving site and from time to time changes made to the site and the services it offers may mean that we have to modify these terms of use. Mumspace.net reserves the right to do so without informing you of these changes, and you should check the terms regularly to ensure that you continue to agree with the current terms.

Intellectual property

The mumspace.net website and the services it offers are protected by copyright and must only be used in a way that is permitted by the terms. By using mumspace.net and its services you are granted a limited non-exclusive, non-transferrable, non-sublicensable license to use mumspace.net and its services for non-commercial use. This license may be withdrawn by mumspace.net at any time and for any or no reason. Further, you must not alter, transform or build on mumspace.net or any service.

The use of mumspace.net for any commercial purpose must first be agreed to by mumspace.net. We reserve the right to suspend any member that in any way promotes a business which would be offensive to mums.

You agree that you will not post images that display or promote any commercial product, unless the image itself directly relates to the content of the post it appears in. This does not apply to advertisements or affiliate banners and the display of any such images is at the discretion of mumspace.net.

You agree that by using the services to create and build your mumspace, mumspace.net is hereby granted a perpetual, non-exclusive, worldwide, royalty-free, transferable right to fully exploit such content (including all related intellectual property rights) and to allow others to do so.

You agree that you will not contribute any content that is defamatory, obscene, abusive, offensive or which violates and law or right of any third party (infringing content). Mumspace.net may remove any content at any time for any reason and you hereby indemnify mumspace.net against any loss or damage suffered as a result of infringing content.

If you believe your copyright has been breached by our services, report it to us by emailing us at support@mumspace.net. We will never knowingly infringe the intellectual property of others.

Your use of the services

The mumspace.net community is a community designed for mums. Members must be a mum or mum-to-be. Any member that is found not to be either will have their membership terminated immediately.

You agree that you will not use the services for any illegal purpose or in any way prohibited by the terms, or in any way other than as an end-user of the services. Examples of prohibited use of the services include:

  • Commercial use (including use to sell a product or service) or use other than personal use, unless such use is approved in advance by mumspace.net;
  • Use in order to increase traffic to your website for commercial reasons unless approved by mumspace.net;
  • Post images of commercially available products that are part of the subjecy matter of the post they are displayed in;
  • Uploading any form of advertisement such as banner or affiliate ads unless approved in advance by mumspace.net
  • Contribution of content which is (or may be considered to be) abusive, threatening or intimidatory or in which you impersonate any other person;
  • Contribution of content which is (or may be considered to be) defamatory, in breach of intellectual property laws, obscene, offensive or which in any way violates the rights of any other person; and
  • Contribution of content which is (or may be considered to be) spam or junk or which is for the purposes of or links to scams or multi-level marketing schemes.

Removal of users and content

Mumspace.net may:

  • block any user at any time for any reason or may remove any content from the mumspace.net site at any time for any reason or no reason at all.
  • terminate or suspend the services (or any of them) at any time and for any reason or no reason at all.

Inactivity of members

Mumspace will suspend any account that remains inactive for 30 days or more. Such accounts may be reactivated by contacting the team at mumspace.net

Fees

The majority of mumspace.net services are free, with members having the option to use mumspace.net's premium services. However we reserve the right to charge fees for services in the future, to introduce new paid services or to convert services from free into paid services.

Cookies

A cookie is a small piece of information associated with a single web site which is stored on your computer by your web browser. There are two types of cookie: session cookies, which are used only for the duration of a single visit to a web site, and are deleted from your computer shortly thereafter, such as when you close your web browser; and persistent cookies, which are stored on your computer until their expiration date, beyond the duration of your current browsing session.

Mumspace.net uses cookies of both types:

  • a session cookie is used to recognise your use of the services; and
  • a persistent cookie is used to identify returning visitors starting a new usage of the services.

These cookies do not contain personally identifiable information, though they do enable us to associate your use of the services with information you have provided to us.

We use cookies to see how people use the services. At present, we associate comments, and tags with users, as well as logging search terms and "clicks" on various buttons on the mumspace.net website.

Mumspace.net allows other entities that may be advertising or publishing with us to set and access their cookies on your computer.

You acknowledge that:

  • mumspace.net is providing the majority of services to you for free and that this affects the extent to which you would seek to hold mumspace.net liable for any matter arising out of the services or their use.
  • mumspace.net is unable to promise you that in the course of using mumspace.net you will not access content which you may find offensive, obscene or otherwise unacceptable.
  • mumspace.net makes no representations in relation to content accessed as via the services, including (but not limited) the accuracy, appropriateness or legality of such content. You should not rely on mumspace.net in deciding to do (or not to) any thing as a result of any content accessed via the services.
  • the services are provided strictly on an "as is" basis and without warranties of any kind (whether express or implied). Excluded warranties include, to the maximum extent permitted by law, warranties as to fitness of purpose, merchantability and non-infringement of third-party rights.

To the maximum extent permitted by law, you release mumspace.net from all and any liability in relation to the services or any content accessed by using the services and you undertake that you will not bring or cause or allow others to bring (or maintain) any claim against mumspace.net or bring any claim or complaint of any kind in relation to the services.

No guarantee of service

Mumspace.net may change, suspend or discontinue the services for any reason or for no reason at any time. We may also impose limits on certain services or restrict your access to any part or parts or all of the services without notice.

General

  • Your use of mumspace.net does not create any agency, partnership, joint venture, or relationship of employment.
  • The failure of mumspace.net to exercise (whether in part or in full) any right provided for in the terms shall not be deemed a future waiver of that or any other right or a waiver of any further of its rights.
  • mumspace.net shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond its control.
  • If any provision of the terms is found to be unenforceable or invalid, that provision shall be eliminated or limited to the minimum extent necessary so that the remaining terms shall otherwise remain in full force and effect and enforceable.
  • Your rights in relation to the services are not assignable or transferable by you.
  • You are not entitled to sub-licence your rights in relation to the services and must not purport to do so in any way. For example, without the prior written permission of mumspace.net you must not make the services available from any website or in any way other than via the mumspace.net website.
  • mumspace.net may assign or transfer its rights in relation to users of the services and does not need your consent before doing so.
  • If you have any complaint of any nature in relation to mumspace.net or the services, before taking any action against mumspace.net you must first direct the complaint to support@mumspace.net for investigation.
  • These terms will be governed exclusively by and construed in accordance with the laws of the State of New South Wales, Australia. You hereby agree that any disputes in relation to the terms or the services will be brought exclusively in the courts of New South Wales, Australia and that you will not make any objection to the jurisdiction of the courts of New South Wales, Australia in relation to any such dispute.
